Disclaimers & Definitions

Service Level Agreement-Process Service

 

Routine Service Guarantees that we will attempt the serve  within the first 3 days of receiving the service and at least 3 attempts within a 14 day period excluding Sunday & holidays.  If your work is received after 3 PM on a business day then it is considered received the next business day.

 

RUSH Service Guarantees that we will attempt the serve within 48 hours, if received before 2 PM (EDT / EST).  We will make at least three attempts within a seven day period.  You MUST call ahead for details.  If received after 2 PM additional charges may apply, these charges are based on the time received and the area that service is required and the amount of printing necessary. 

 

SAME DAY Service Guarantees that we will attempt the serve on the same day received if received before 11 AM (EDT / EST).  You MUST call ahead for details.

 

Service Level Agreement-Court Filing & Court Research

 

Routine Service Guarantees that we will attempt to file the documents within the first 3 court days of receiving the documents.  These are often completed the next day but this is not guaranteed. If you want a guarantee that it will be filed the next day or the same day please use RUSH SERVICES or SAME DAY SERVICES.

 

RUSH Service Guarantees that we will attempt to file the documents by the time the court closes within 2 business days.  You MUST call ahead for details.

 

SAME DAY Service Guarantees that we will attempt to file the documents by the time the court closes on the same day received. Usually we have a deadline of 3 hours before the court closes, this is a first come first serve basis, and we can typically do anything within reason.  We suggest calling ahead and after documents are sent to us to ensure we can handle the request.  

 

Skip Tracing-Neither our company nor any other company can guarantee that this will positively get the correct address or phone number you are looking for.  The data is collected by humans and subject to human error, plus humans do lie and give false data.  We do not collect the data, we use a secured database that we have to go through several background checks just  to access. Additionally, the address might have been a good address last month but the subject(s) moved last week.

 

NOTE:  If sending a SAME DAY or RUSH Service, we require that you call us before and after the documents have been sent to us, fore warning us will help us help you.  See disclaimers below for more information.  Some research can take a lot longer than expected due to things like court closures, court's changing and limited hours, public events, documents not being on site, multiple locations that require on site visits, court or facility limitations to pages being copied, other court or facility procedures, plus more.  

 

Limitation of attempts for Service of  Process - We will make up to 3 attempts to serve any party, this may not always be the case, there are circumstances where this is not going to happen.  For example, if we arrive and the TV is on and there is a car in the driveway and the neighbor states that they are home, and the peephole goes dark after knocking but no one answers the door, they are clearly evading service of process, we might choose to stop attempting and offer other services to get the entity served.

 

Bounced Checks and Payments - Any bounced check will be subject to a $25.00 fee in addition to the original charges.  Credit Card transactions that get charged back will be subject to a $25.00 fee in addition to the original charges.  Any service requests entered into our software system will be subject to a minimum $10.00 clerical charge even if no work is performed.  This is to cover our costs for cancelled service requests.  This does not include the costs of printing faxes, e-mails, copies, etc...  It also does not include the use of supplies like paper, exhibit tabs and other such items.  Research time may not be included in the clerical fees either.  We charge differently based on what your needs are.  You need to put everything you want completed in writing, make it clear if it is out of the ordinary, call to discuss first.  For most attorney service companies, including most NAPPS and CalsPro companies, the Proof of Service, advancing fees, and mailings, are completed by the forwarding company, not the serving company.

 

Waiting Time - If your services require waiting time, as in waiting at a gate for someone to come in or out to gain entry, we charge for that after 5 minutes.  If we need to serve a subject and the subject is in a meeting, we will wait only upon your approval and thus charge waiting time.  If there is a scheduled appointment to attend and the subject is late and we are forced to wait there will be waiting time charges added, if we can call and discuss we will but we might be forced to make a decision and wait and thus charge without your approval, again call to discuss this before we execute the plan.  We will always mention this when calling in.     

 

Appointments - We suggest that you call to discuss, not all appointments can be made, we have experience with this and often can accommodate your situation, and additional charges may apply.  

 

Same Day Services - Always call in to ensure we can handle the request, sometimes we are not able to complete your service due to our staff being hired prior to your work request, court closures, traffic, public protests, special events, Presidential visits, or anything else out of our control, we will however inform you of this immediately.

 

Date of Receiving - We consider receiving your documents before 3 PM on a business day, if received after 3 PM on a business day then it is considered received the next business day.

 

Service of Process & Court Filings - We cannot guarantee that your filing, research, or serve will be completed. We can only guarantee that we will attempt within our service level agreement to attempt to serve or file, research your request.

 

Service of Process Guarantee - We will guarantee that we will follow our service level agreement, see Process Serving.  We DO NOT and CANNOT guarantee that we will serve your documents, anyone or company that does, be wary.  For all you and I know the subject could have left town or moved an hour ago and will stay away for years.

 

VARIOUS SITUATIONS

 

WRONG ADDRESSES, NOT FOUNDS, BAD ADDRESSES, EVADING SERVICE, DECEASED, MOVED, CANCELLED, ETC...No Discounts.  ONLY for volume based clients.  Full charges still apply unless it is a Bad Address or Cancelled Service with no attempts.

·         Bad Addresses/Cancelled - If an attempt was made, full charges will be applied.  If we simply cannot find the address on a map we will only charge $10.00 for the process of receiving the work order, entering, (plus any possible printing charges) and dispatching.  We check 1 map source, google.com and the USPS before determining this.

·         Evading Service - If we determine that the subject is evading service or the subject's associates are assisting the subject to evade service we reserve the right to immediately stop service and ask for a stakeout, new address, or new means of contacting the subject.  This may constitute additional charges, please call us for detailed explanation.  We may also continue service if we feel we can actually serve the subject.

 

MISSING INFORMATION

If we do not make an attempt, we will only charge $10.00 for the process of receiving the work order, entering, printing (plus any possible printing charges) and dispatching.  We check 1 map source, google.com and the USPS before determining this. If we attempt a given address and there is a piece of missing information, like an apartment number, "address verified", and/or "back unit/in-law unit"  the serve will be considered "Not Found" or "closed out".  If the missing information is given to us later it will be considered a separate serve and new charges will apply
